Terms of Service

Welcome to eMotion Charging and LECO Charging, services provided by Mobility Alliance. These Terms of Service (“Terms”) govern your access to and use of the eMotion Charging and LECO Charging mobile apps, websites, and any related services (collectively, the “Services”). By using our Services, you agree to comply with these Terms. If you do not agree to these Terms, please do not use our Services.
1. Acceptance of Terms
By creating an account, accessing, or using the eMotion Charging or LECO Charging apps or any related services, you agree to be bound by these Terms and our Privacy Policy. You represent that you are at least 18 years old or the legal age of majority in Sri Lanka and have the legal authority to enter into these Terms.
2. User Accounts
To use certain features of our Services, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information.
- Keep your account information updated.
- Maintain the security of your account by protecting your password and restricting access to your account.
- Notify us immediately if you discover or suspect any unauthorized use of your account or any other security breaches.
- Be responsible for all activities that occur under your account.
3. Use of Services
You agree to use the eMotion Charging and LECO Charging Services only for lawful purposes and in accordance with these Terms. You will not:
- Use the Services in any way that violates any applicable local, state, national, or international law or regulation.
- Use the Services for any unauthorized, fraudulent, or malicious purposes.
- Access or use the Services to transmit any material that is defamatory, harassing, threatening, obscene, or otherwise inappropriate.
- Attempt to gain unauthorized access to any portion of our Services or any systems or networks connected to our Services by hacking, password mining, or other illegitimate means.
- Interfere with or disrupt the security, integrity, or performance of the Services.
- Misuse any of eMotion Charging or LECO Charging’s EV Charging Stations.
- If the charging speed on a DC Fast Charger is too low to qualify as “Fast Charging,” specifically if it falls below 10kW, the charging session will terminate and you will be unable to charge for a period of 30 minutes.
- Leave your vehicle unattended regardless of whether your vehicle is charging or not, at a DC Fast Charger.
4. Payment and Fees
Certain features of the eMotion Charging and LECO Charging Services, such as charging your vehicle or topping up your account, may require payment. You agree to pay all applicable fees and charges associated with your use of these features.
- Payment Methods: We accept various payment methods, including credit and debit cards. You agree to provide accurate and complete payment information and authorize us to charge your selected payment method for all fees due.
- Billing Information: We store the payment method’s first and last name and the expiry date but do not store card numbers or CVC numbers. Payment processing is securely handled by our third-party payment processor.
- Refund Policy: All payments are final and non-refundable unless your vehicle is incompatible with eMotion Charging or LECO Charging chargers.
- Once we receive your complaint, we will notify you of the status of your refund. If your complaint is approved, we will initiate a refund to your original method of payment. Please note that the refund amount will exclude any shipping charges incurred during the initial purchase.
- Refunds will be processed within
7business days after we confirm your inability to charge on our chargers. Please note that it may take additional time for the refund to appear in your account, depending on your payment provider.
5. Vehicle and Charging Data
By using eMotion Charging or LECO Charging, you consent to the collection, use, and storage of your vehicle data, charging history, and top-up transaction history as described in our Privacy Policy. This data is used to enhance your user experience, provide tailored services, and improve the performance of our network.
6. Responsibility for Damage to Charging Stations
You agree to use the charging stations provided by eMotion Charging or LECO Charging with due care and diligence. You will be responsible for any damage to the charging stations caused by your actions, negligence, or misuse of the equipment. This includes, but is not limited to, damage resulting from:
- Improper use of the charging equipment.
- Tampering with, modifying, or attempting to repair the charging station.
- Failure to follow the instructions or guidelines provided by eMotion Charging or LECO Charging.
If any damage is caused by you, Mobility Alliance reserves the right to seek compensation for the cost of repairs or replacement, including any associated costs such as labor or downtime.
7. Intellectual Property Rights
All content, features, and functionality provided through the eMotion Charging and LECO Charging Services, including but not limited to software, text, graphics, logos, and images, are the exclusive property of Mobility Alliance or its licensors and are protected by applicable intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Services solely for personal, non-commercial purposes.
- You agree not to modify, distribute, transmit, reproduce, publish, license, create derivative works from, or sell any content, software, products, or services obtained from the Services without prior written consent from Mobility Alliance.
8. Limitation of Liability
To the maximum extent permitted by law:
- Mobility Alliance shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of or inability to use the eMotion Charging or LECO Charging Services.
- We do not guarantee the availability, accuracy, or reliability of the Services and are not responsible for any loss or damage resulting from any interruptions, errors, or omissions in the Services.
- Your sole remedy for dissatisfaction with the Services is to stop using them.
9. Indemnification
You agree to indemnify, defend, and hold harmless Mobility Alliance and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in connection with:
- Your use or misuse of the Services.
- Your violation of these Terms or any applicable laws or regulations.
- Any dispute or issue between you and any third party.
- Any damage you cause to eMotion Charging or LECO Charging connected charging stations or other property.
10. Termination
We reserve the right to suspend or terminate your access to the eMotion Charging and LECO Charging Services at any time, with or without notice, for any reason, including, but not limited to, your breach of these Terms.
Upon termination, all provisions of these Terms that, by their nature, should survive termination, including ownership provisions, disclaimers, indemnities, and limitations of liability, will continue to apply.
11. Modifications to the Terms
We may update these Terms from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. We will notify you of any significant changes by posting the new Terms on our website or app and updating the “Last Updated” date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or related to these Terms or your use of the Services shall be brought exclusively in the courts located in Sri Lanka.
